Rules on the use of green spaces

The Barcelona Environment Byelaw lays down a set of regulations to, among other aims, maintain the quality of public spaces and look after and improve Barcelona's green spaces, as well as protecting and conserving the city's biodiversity. 

Title 7, which governs GREEN SPACES AND BIODIVERSITY, regulates the implementation, maintenance, use and enjoyment of green spaces and biodiversity and their various elements. 

The rules on the use of green spaces also include the regulations set forth in the Byelaw on measures to foster and ensure the peaceful coexistence of local residents in Barcelona's public spaces, as well as those of related strategic plans.

What do I need to know?

  • You must always act in a way that is respectful of plants, installations, facilities and urban furniture. 
  • You must obey the instructions, posters and signs provided. If you are unsure about any of the information contained in them, you can check the Signage Manual for Green Spaces. 
     
  • You must obey any observations and requests from Guàrdia Urbana city police officers or the green spaces' own conservation and surveillance staff.
  • No conducts or attitudes entailing the use of public spaces as if they were private are permitted. Green spaces for public use are for everyone to enjoy.

Prohibitions

The following are prohibited in all green spaces: 

  • Discarding paper, waste or rubble other than in the designated places, or otherwise dirtying the area.
  • Starting or sustaining a fire outside the designated areas.
  • Discarding lit cigarette butts or matches. 
  • Releasing balloons, throwing bangers or setting off fireworks outside the areas designated for specific events. 
  • Washing or bathing animals in fountains or ponds. 
  • Riding horses outside the permitted places. 
  • Camping. 
  • Parking, cleaning or repairing vehicles or mopeds, or doing maintenance work on them. 
  • Washing and hanging laundry. 
  • Taking water from irrigation nozzles, ponds or water courses. 
  • Affixing posters on doors, public lamp posts, plants or other urban furniture, or placing advertisements or signs (unless duly authorised). 
  • Tying bicycles or any other items to plants (such as tree trunks) or urban furniture. 
  • Hunting. 
  • Cutting or pulling out fruit, roots or plants.
  • Chopping any kind of firewood without due authorisation. 
  • Taking away moss, topsoil, stones, sand or similar.

The following are not permitted:

  • Cycling or skating outside the designated areas or those where this is expressly permitted. Bicycles and personal mobility vehicles can be ridden in those parks and gardens where they are allowed to be brought in, provided they always stay on the paths and walkways, at no more than 10 km/hour and always giving way to pedestrians.
  • In the case of enclosed spaces, such vehicles cannot remain there once notice of closing has been given.
  • Having meals outside the areas properly designated as picnic areas or those duly authorised by the manager of the space.

What should I do with my pet(s) when entering a park?

  • Pets must be kept on a leash at all times (with a collar and a lead or chain) in all urban parks. *They can only be taken off the leash in the areas specifically designated as pet recreation areas, such as dog recreation areas or areas where dogs may be taken off the leash during specific time slots.
  • Due to their specific characteristics, pets may be forbidden in some parks. This will be expressly stated on the entrance signs.  *This prohibition does not apply to guide dogs.
  • You may play ball games or do exercise in the specially designated spaces or enclosures, such as the multi-sport courts, sports circuits, basketball hoops or table-football tables available in some green spaces.
  • You can also play ball games and use other mechanical or similar items in parks and gardens, unless it is expressly forbidden on the entrance signs because the space in question is specially protected due to the characteristics of its plants or architecture.
  • Sports or recreational activities that may disturb other users or threaten their safety or relaxation, or that may affect the plants or damage the facilities in the green space, are similarly prohibited.
  • You may not engage in any activities that alter green spaces' ecological conditions and biodiversity.
  • All activities that cause changes to the environment and the conditions of plants and wildlife are prohibited. These include, among others:
    • Altering the physiography of the land and the physicochemical characteristics of the soil. 
    • Altering water courses (both natural and artificial ones) or putting anything in the water.
    • Any emissions capable of affecting air quality.  
    • Engaging in noisy or annoying activities.  

Regarding protecting plants, the following are prohibited to ensure that they are able to thrive:

  • Tampering with plants in any way. 
  • Cutting down, pruning, shaking or breaking off parts of trees and bushes. 
  • Carving or marking the barks of trees and bushes; driving sharp objects into them and tying ladders, tools, scaffolding, mopeds, bicycles, posters or anything else to them. 
  • Stepping on the grass in those areas in which it is specifically forbidden to do so. 
  • Altering flowerbeds or sloped surfaces. 
  • Climbing trees. 
  • Cutting off flowers, branches, fruits, seeds and roots. 
  • Planting or doing other gardening work without authorisation.

Regarding protecting wildlife, you must respect the animals living in green spaces and refrain from doing anything that could harm them. You may not:

  • Kill, hunt, fish or in any way harm birds, fish or other animals in green spaces. 
  • Throw or pour any kind of object or waste into lakes, ponds, fountains or water courses. 
  • Intentionally bring in or abandon any animals. 
  • Feed animals that are in these spaces, whether they are there on a permanent or temporary basis.

As regards decorative elements or facilities in green spaces, you are not allowed to:

  • Destroy, damage or dirty any component, facility or architectural element (for example, defacing, painting or drawing on urban furniture, children's play items or architectural elements or using them in any way other than as intended).
  • Tampering with any part of the irrigation network or public fountains.
  • Moving or knocking over urban furniture or pulling it out of the ground; carving it or affixing stickers on it. 
  • Using facilities other than as intended, such as the use of children's play items by adults or by children above the intended age.
  • Drinking or otherwise using the water of decorative fountains, or getting into them.
  • Climbing, swinging or in any way physically interacting with sculptures, signs or other decorative items in the city.

Motorised vehicles may not be driven in green spaces.

Exceptions:

  • Private vehicles with prior authorisation in exceptional cases, provided there are roads, tracks or paths where motor vehicles are allowed, always at under 10 km/hour. 
  • Conservation vehicles, as well as supply vehicles for licence holders or other services, at the stipulated times and with the applicable municipal permit, always at under 10 km/hour. 
  • Electric or non-motorised vehicles belonging to people with reduced mobility. These can be ridden on pedestrian streets or paths in green spaces provided they do not exceed a maximum speed of 10 km/hour.

Authorisation for activities, events and advertising

  • You may not engage in any activities that alter green spaces' ecological conditions and biodiversity. All activities that cause changes to the environment and the conditions of plants and wildlife are prohibited.
  • Commercial or industrial activities of any kind, be they permanent or temporary, may only be carried out with the relevant municipal concession or licence.
  • Artistic, sporting, social or cultural events and activities are permitted, with a municipal licence, provided they do not entail a risk to the conservation of green spaces or to biodiversity and they are compatible with the public use of the spaces.
  • Obtaining authorisation for public events entails, in accordance with the body in charge of environmental matters, taking steps in advance to avoid any possible damage due to the greater influx of people or as a result of the event itself. Notice of these authorisations must be given sufficiently in advance to enable the necessary preventive measures to be taken. 
  • No advertising of any kind may be carried out without first obtaining the required licence. This includes both static and dynamic advertising, as well as using loudspeakers or audiovisual devices of any kind.

Information that must be submitted:

  • Application form for authorisation to use of Barcelona's public green spaces and beaches (events).
  • Application form for a licence to hold public shows and activities of an extraordinary nature organised in public highways with a capacity of up to 1,000 people.
  • To assess the use of public space in Barcelona's parks, gardens, and beaches, the information indicated in the following document must also be attached.

Information that must be submitted:

  • Application form for authorisation for filming and sessions in Barcelona's public green spaces and on the beaches.

Upkeep of green spaces (both public or private)

They must keep the green spaces in good condition and carry out the necessary work in relation to them. This includes:

  • Cleaning them and maintaining hygiene. 
  • Monitoring plants' phytosanitary condition. 
  • Tree pruning and treatment. 
  • Refraining from planting any plant species that are likely to attract pests or suffer from chronic diseases.
  • Ensuring that the elements of green spaces do not encroach on public roads or spaces or interfere with their use. If this happens in private green spaces, the cost of repairs must be borne by their owners.
  • The spaces must be kept free from undergrowth, with the trees thinned out, their lower branches pruned back, and with dry and dead vegetation cleared away along with any waste materials of any kind that could help spread a fire. 
  • Dead and dangerously leaning trees must be removed. 
  • Fire warning signs must be displayed.
  • No huts, cabins, shacks or similar structures may be built. 

NOTE: The Barcelona Municipal Institute of Parks and Gardens cannot issue regulations. This can only be done by Barcelona City Council. In addition, all procedures fall under Barcelona City Council's administrative procedures.

Penalties

  • Lighting a fire outside the designated areas. 
  • Bringing in invasive species. 
  • Cutting down trees or causing them to die, or damaging them in a way that renders them unsalvageable.
  • Infringements generally considered to be serious, if they cause very serious damage. Infringements generally considered serious, if they are committed more than once a year by the same (natural or legal) person.
  • Disrupting or disturbing existing wildlife. 
  • Shaking or mutilating trees or bushes. 
  • Carving the bark of trees. 
  • Wounding, cutting off roots, branches, leaves, flowers, fruits or seeds of the various plant species in green spaces with significant consequences for those species. 
  • Pouring waste or harmful liquids, or leaving building materials or tools on plants, urban furniture or children's play items. 
  • Intentionally bringing in pets or wild animals. 
  • Damaging urban furniture, children's play items or architectural elements. 
  • Setting up commercial, artistic or advertising facilities without the necessary authorisation. 
  • The inadequate upkeep of private green or woodland areas if it entails a danger to the public. 
  • Altering the physiography or characteristics of the soil or water courses. Putting toxic substances in water courses. 
  • Infringements generally considered to be serious, if they cause very serious damage.
  • Infringements generally considered serious, if they are committed more than once a year by the same (natural or legal) person.
  • Stepping on the grass or plants in areas where this is not permitted. 
  • Cutting or pulling out leaves, flowers, fruits or seeds. 
  • Climbing trees. 
  • Doing gardening in public green areas without permission. 
  • Engaging in activities that interfere with other users' enjoyment.
  • Dirtying green spaces or parts of them in ways other than as envisaged in the list of serious or very serious infringements. 
  • Taking dogs into urban parks without a leash, and allowing them to go into landscaped areas, children's play areas and ponds or to damage plants or facilities in green spaces. 
  • Failing to pick up dog faeces or those of other pets for which you are responsible. 
  • All other actions included under environmental protection and the prohibitions.
